1. General Provisions and Acceptance

These Terms of Use ("Terms") govern the terms and conditions regarding the use of all products, contents, and services ("Services") offered through the Kenn Paul branded website and mobile platforms ("Site") operated by 3K İÇ GİYİM ÜRÜNLERİ İTHALAT İHRACAT İNŞAAT SANAYİ VE TİCARET LİMİTED ŞİRKETİ ("Company", "we").

By visiting the Site, registering, or shopping on the Site, you declare that you have read, understood, and accepted these Terms. If you do not accept the Terms, you must not use the Site.

These Terms have been prepared in accordance with the legislation of the Republic of Turkey in force, primarily the Turkish Code of Obligations No. 6098, the Turkish Commercial Code No. 6102, the Law No. 6502 on the Protection of Consumers, the Law No. 6563 on the Regulation of Electronic Commerce, and the Regulation on Distance Contracts.

2. Membership and Account Security

  • You can create a membership to shop on the Site, or place an order as a guest without becoming a member.
  • You are responsible for ensuring that the information you provide when creating a membership is accurate, current, and complete.
  • You are responsible for the confidentiality of your username, password, and account information, as well as all actions performed under your account. If you suspect unauthorized use of your account, you must notify us immediately at info@kennpaul.com.
  • Individuals under the age of 18 cannot shop on the Site without the supervision and consent of a legal parent/guardian.

3. Products, Prices, and Order Process

  • Product images, descriptions, and price information on the Site are for promotional purposes; there may be color deviations resulting from screen/device differences.
  • Product prices are in Turkish Liras (TL) and include VAT unless explicitly stated otherwise.
  • The Company reserves the right to make changes to the product, price, campaign, and stock information on the Site without prior notice. In case of inaccuracies arising from price and description errors, the Company has the right to cancel the relevant order.
  • An order is established when the buyer completes the payment step on the Site and the Company confirms the order. The Company reserves the right to cancel or reject the order for justified reasons such as insufficient stock, payment issues, or detection of suspicious transactions.
  • The sales contract is effective together with the Distance Sales Agreement electronically approved on the Site.

4. Payment

  • Payments are performed through the secure payment infrastructures (credit card, debit card, and/or other payment methods) offered on the Site.
  • Your card details are not stored by the Company; payment transactions are carried out through the secure infrastructure of the relevant payment institution.
  • The conditions applied to installment transactions are subject to the campaign and installment policies of the relevant bank/card institution.

5. Delivery

  • Products are shipped to the address specified in the order within the estimated delivery times indicated on the Site, via contracted cargo companies.
  • Delivery times may vary depending on product characteristics, stock status, and delivery address; the specified times are estimated and do not constitute a binding commitment.
  • In case of delays or disruptions in delivery due to force majeure (natural disasters, weather conditions, delays caused by cargo companies, etc.), the Company's liability is limited to the extent provided by the relevant legislation.

6. Right of Withdrawal, Return, and Exchange

The conditions for the right of withdrawal, return, and exchange are regulated in the Cancellation and Refund Policy published separately on the Site. Please review the relevant policy for all details, including withdrawal exceptions applied in underwear products (e.g., boxers) due to hygiene reasons.

7. Intellectual Property Rights

  • The "Kenn Paul" brand, logo, design, image, text, software, and all other content on the Site belong to the Company or its licensors and are protected under the Law No. 5846 on Intellectual and Artistic Works and the Industrial Property Law No. 6769.
  • Reproduction, distribution, modification, or commercial use of the Site content is prohibited without the prior written consent of the Company.
  • You may use the Site only for personal and non-commercial purposes in accordance with these Terms.

8. User Obligations

When using the Site, you agree to refrain from the following behaviors:

  • Performing transactions with false, misleading, or someone else's information,
  • Engaging in activities that will threaten the security of the Site, disrupt its operation, or provide unauthorized access,
  • Using the Site content unlawfully, for fraud, or in a way that violates the rights of third parties,
  • Abusing the order process (e.g., unrealistic orders, malicious return requests).

In case of violation of these obligations, the Company reserves the right to suspend, terminate the relevant account, or cancel the order.

9. Limitation of Liability

  • The Company does not guarantee that the Site will operate uninterruptedly, error-free, or securely; it cannot be held liable for indirect damages arising from technical disruptions to the maximum extent permitted by applicable legislation.
  • If redirection is made to third-party links on the Site, the Company is not responsible for the content of the third-party sites in question.
  • The Company's liability arising from consumer transactions is applied with the reservation of the provisions of Law No. 6502 and the relevant legislation.

11. Changes

The Company reserves the right to update these Terms of Use at any time in accordance with the legislation in force. The updated Terms enter into force on the date they are published on the Site. Your continued use of the Site following the changes means that you accept the current Terms.

12. Applicable Law and Dispute Resolution

These Terms are subject to the laws of the Republic of Turkey. In disputes that may arise from these Terms, Consumer Arbitration Committees in the place of residence of the buyer or the Company are authorized within the monetary limits declared by the Ministry of Trade, and Consumer Courts are authorized in disputes exceeding these limits.
