This policy has been prepared in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and is valid for all purchases made via www.[yourwebsiteaddress].com.

1. Right of Withdrawal

The Buyer has the right of withdrawal within 14 (fourteen) days from the date of delivery of the goods to themselves or to the person/organization at the designated address, without assuming any legal or penal liability and without giving any justification. In determining the withdrawal period:

  • For goods that are subject to a single order but delivered separately, the day the last good is received,
  • For goods consisting of more than one piece, the day the last piece is received is taken as basis.

To exercise the right of withdrawal, it is sufficient to notify the Seller in writing (via e-mail, contact form, or phone) within the 14-day period.

2. Exception to the Right of Withdrawal in Underwear Products (Hygiene Rule)

Pursuant to Article 15/1-ğ of the Regulation on Distance Contracts; the right of withdrawal cannot be exercised for products whose return is not suitable in terms of health and hygiene, such as underwear bottom pieces, swimsuits, bikini bottoms, if their packaging has been opened, or if they have been tried on, washed, or used.

In this context, the following conditions apply to Kenn Paul men's boxer products:

  • The original packaging of the product (including the hygiene tape/label) must be unopened, undamaged, and intact.
  • The product must be unworn, untried, and unwashed.
  • All labels, hygiene tape, and original packaging belonging to the product must be returned complete.
  • Boxers whose packaging has been opened, hygiene tape has been torn, or determined to have been used will not be accepted for return or right of withdrawal due to health and hygiene reasons.

This exception is not intended to victimize the consumer but arises from the mandatory hygiene protection obligation imposed by the relevant legislation on underwear products.

3. Return of Defective (Faulty/Damaged) Products

The above hygiene exception does not apply in cases of defective goods. In the following cases, return/exchange requests are accepted even if the packaging of the product has been opened:

  • Shipment of the wrong size or wrong product;
  • Production defects (stitching errors, fabric defects, cutting errors, etc.);
  • Non-conformity of the product with the described specifications;
  • Cargo-related damages (damages occurring during delivery).

In these cases, the consumer may exercise one of their rights under the defective goods provisions (Articles 8-12) of Law No. 6502: free repair, replacement with a non-defective equivalent, price discount, or rescission of the contract. The request must be submitted within a reasonable time from delivery by making a photo-notified report to our support team.

4. Other Situations Where the Right of Withdrawal Cannot Be Exercised

Pursuant to Article 15 of the Regulation, the right of withdrawal cannot be exercised in the following cases as well:

  • Products prepared in line with the Buyer's requests or personal needs (customized size/print, etc.);
  • Products whose protective elements such as packaging, tape, seal, pack have been opened after delivery and whose return is not suitable for health/hygiene reasons (see Article 2);
  • Goods whose price changes depending on fluctuations in financial markets.

5. Method of Exercising the Right of Withdrawal

The buyer who wishes to exercise the right of withdrawal:

  • Must submit a written notification to the Seller within 14 days through the following communication channels:

  • Must send the product back to the Seller within 10 days from the notification date, together with its invoice, with the original packaging undamaged and the hygiene tape not removed.
  • The shipping cost is covered by the Seller if the right of withdrawal is exercised in accordance with the procedure; if the product is not suitable for return conditions, the shipping cost belongs to the buyer.

6. Payment of the Refund Amount

Within 14 days at the latest following the proper exercise of the right of withdrawal and the receipt of the product by the Seller complete, undamaged, and in compliance with the return conditions, the product price is refunded to the buyer in a manner appropriate to the payment tool used in the purchase and without incurring any expenses to the buyer.

7. Competent Authority in Case of Disputes

In disputes that may arise from this policy, Consumer Arbitration Committees (Tüketici Hakem Heyetleri) in the place of residence of the buyer or the Seller are authorized within the monetary limits determined annually by the Ministry of Trade, and Consumer Courts (Tüketici Mahkemeleri) are authorized in disputes exceeding these limits.
