1. General Information
The website with the domain name www.kennpaul.com ("Site") is operated by 3K İÇ GİYİM ÜRÜNLERİ İTHALAT İHRACAT İNŞAAT SANAYİ VE TİCARET LİMİTED ŞİRKETİ ("Company"), and the Site's infrastructure is provided through Shopify Inc.
All visitors/users who access and use the Site are deemed to have accepted the matters contained in this Legal Notice. This text must be evaluated as a whole with the Terms of Use, Privacy Policy, Cancellation and Refund Policy, Distance Sales Agreement, and our obligations under the Law No. 6698 on the Protection of Personal Data ("KVKK").
2. Accuracy and Timeliness of Contents
The Company shows reasonable care to ensure that product descriptions, prices, campaigns, images, and all other information on the Site are accurate and up-to-date; however:
- Errors or omissions may occasionally occur in the information on the Site due to technical glitches, system errors, or update delays.
- Product images are representative, and there may be differences in color and appearance depending on the features of the screen/device used.
- The Company cannot be held liable for damages that may arise from such errors and omissions to the maximum extent permitted by applicable legislation, except in cases of intent or gross negligence.
3. Limitation of Liability
The Company makes no warranties and accepts no liability in the following matters:
- That the Site will operate uninterruptedly, error-free, or free of viruses and other harmful components;
- Interruptions in access or data loss caused by internet connection, server, or third-party infrastructure (Shopify and integrated services);
- The content, accuracy, or security of third-party websites linked through the Site;
- Damages that may arise from the user's use of the Site out of purpose or unlawfully.
The Company's liability is limited to the maximum extent permitted by applicable legislation, with the reservation of the provisions of Law No. 6502 on the Protection of Consumers and the relevant legislation regarding consumer transactions.
4. Intellectual Property Rights
The "Kenn Paul" brand, logo, slogan, design, image, photograph, text, software code, and all other content ("Content") on the Site belong to the Company or its licensors and are protected under the Law No. 5846 on Intellectual and Artistic Works, Industrial Property Law No. 6769, and other relevant legislation.
The Content, in whole or in part, cannot be reproduced, distributed, processed, communicated to the public, used for commercial purposes, or published in another medium without the prior written consent of the Company. Use contrary to this rule triggers legal and penal liability.
5. User Comments and Contents
Users who share product reviews, comments, or similar content through the Site are personally responsible for ensuring that their shared content does not violate the law, public morality, and the rights of third parties. The Company reserves the right to remove inappropriate, misleading, or unlawful content without prior notice.
6. Third-Party Links and Shopify Infrastructure
The Site provides services through the infrastructure of Shopify Inc., and third-party service providers are utilized for some functions such as payment, hosting, security, and analysis. The Company is not responsible for the content and privacy practices of third-party linked sites (social media, payment institutions, cargo tracking systems, etc.) that may be included in the Site; it is the user's responsibility to review the usage and privacy terms of these sites.
7. Protection of Personal Data (KVKK Information Text)
7.1. Data Controller: In accordance with the Law No. 6698 on the Protection of Personal Data ("KVKK"), your personal data obtained through the Site or other channels may be processed by 3K İÇ GİYİM ÜRÜNLERİ İTHALAT İHRACAT İNŞAAT SANAYİ VE TİCARET LİMİTED ŞİRKETİ in the capacity of data controller within the scope explained below.
7.2. 7.3. Transfer: Your personal data may be transferred to cargo/logistics companies, payment institutions, Shopify Inc. providing the Site infrastructure, and integrated third-party service providers, and to authorized public institutions and organizations if deemed necessary, in accordance with the conditions provided in Articles 8 and 9 of the KVKK. Due to Shopify's infrastructure, your data may be transferred abroad; in this case, necessary protection measures under Article 9 of the KVKK (explicit consent, adequacy decision, or equivalent contractual mechanisms) are taken as basis.
7.6. Your Rights: In accordance with Article 11 of the KVKK, you have the right to: learn whether your personal data is processed; request information if processed; learn the purpose of processing and whether it is used in accordance with the purpose; know the third parties to whom data is transferred domestically or abroad; request correction if incomplete/inaccurately processed; request deletion/destruction; request notification of the correction and deletion transactions to the third parties to whom data is transferred; object to any results that arise to your detriment due to analysis via automated systems; and request compensation for damages in case of unlawful processing causing damage.
7.7. Application Method: To exercise your rights listed above, you can send your requests in writing to info@kennpaul.com or to Sururi Mah. Hocahani Sokak, Eğirdir Şen Han No: 15 B, Fatih / İstanbul, together with documents verifying your identity. Your requests will be concluded free of charge within 30 days at the latest depending on their nature. If your request is not met, your right to file a complaint with the Personal Data Protection Board (kvkk.gov.tr) remains reserved.

8. Notification of Intellectual and Industrial Property Infringement
If you think that any content on the Site violates your intellectual property rights, you can send your request to info@kennpaul.com together with supporting documents. Your request will be examined and you will be contacted within a reasonable period.
9. Applicable Law and Authorized Court
This Legal Notice is subject to the laws of the Republic of Turkey. Istanbul (Anatolian/European) Courts and Enforcement Offices are authorized in disputes that may arise from this text; the jurisdiction of Consumer Arbitration Committees and Consumer Courts provided by Law No. 6502 is reserved for users who have consumer status.

The Company reserves the right to update this Legal Notice text at any time in accordance with the legislation in force. The current text becomes valid from the moment it is published on the Site.
